Rightgive – General Terms & Conditions

Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the Rightgive mobile app and website (the “Service”) operated by The Dawah Project (“us”, “we”, or “our”).

Your access to and use of the Service is conditional on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the Terms then you may not access the Service.

Summary

Terms of Service

We may update these Terms from time to time. It is your responsibility to review these Terms wherever you access the Service. The latest version of these Terms will govern any future usage by you of the Services. The date on which these Terms were last updated is at the end of this document.

Your donation

Subject to the requirements of applicable local laws, once your donation is made, rightgive is under no obligation to refund your donation to you. You agree any request for a refund must be made by you directly to the Recipient to which the donation has been directed. All registered charities are responsible for and process their own refunds.

In connection with a refund request for a Recipient other than a charity, rightgive may permit a refund with the prior written authorisation of the Recipient to which the donation has been directed. Please get in touch with the Recipient to which you have donated and explain that you would like a refund and that they must confirm this to us in writing.

If all funds have already been paid out to the Recipient and there are no funds available for refund, rightgive will only process approved refunds where the Recipient has retuned the donation amount to us. Alternatively, you may approach the Recipient for a direct refund from them. Under no circumstances will rightgive be liable for funding the refund of any donations itself.

Rightgive is not responsible for the planning, delivery and management of any fundraising campaigns. If such a campaign is cancelled, postponed or changed, a rightgive fundraising page relating to any such campaign will remain open and eligible to receive donations unless the person who created the campaign chooses to close it. Rightgive will not, and is under no obligation to, inform a donor or fundraiser that a fundraising campaign has been cancelled, postponed or changed. In such circumstances, subject to applicable local laws, no donation made to a rightgive fundraising page will be refunded by rightgive except with the prior written consent of the Recipient to whom it has been directed (who will be responsible for funding the refund) as provided above.

No donations will be refunded for any reason, subject to applicable local laws. Occasionally, the person who created the cause to which you have donated does not pass identity verification or other necessary checks, or there is some other reason that we cannot transfer the funds to them. If we are unable to transfer the funds to the Recipient to which you donated, we will return your donation via the payment method from which you made the donation. If we are unable to return your donation via the payment method you used, your donation will be sent to another Recipient, subject to the deduction of applicable transaction and payment processing fees.

Use of your donation

Rightgive does not represent or warrant that your donations will be used for any particular purpose and shall not be responsible for any dissatisfaction you may have regarding a Recipient’s use of any donation you may make through the Service or for any misuse or non-use of such donations by a Recipient. After donations are made, all further dealings are solely between you and the Recipient to which you donated.

Rightgive (or any payments processor we work with) will verify the identity of a rightgive campaign page creator and undertake any other necessary checks before any funds raised are transferred to the Recipient. Rightgive shall have no liability to donors whatsoever for any use or misuse of donations made to such Recipient. The fundraising campaign may state that the Recipient will use donations only for specific purposes, but rightgive cannot guarantee that they will use them for such purpose. If you have any doubts as to how the money will be spent, you should contact the Recipient directly to seek reassurance. It is your sole responsibility, as a user of the Service, to ensure that the cause stated to be supported on a relevant campaign is one that you wish to support.

User conduct

Building a rightgive page in aid of a cause in no way implies rightgive’s endorsement of your fundraising activity. Prior to commencing a fundraising activity, it is your responsibility to ensure that the benefitting cause/Recipient has no objection to the nature of the proposed activity. rightgive reserves the right, at its absolute discretion and without notice, to cancel your personal fundraising page at the request of the cause or Recipient if the cause or Recipient, in its absolute discretion, deems your fundraising activity inappropriate or unnecessarily dangerous.

Gift Cards

Please refer to our Rightgive Gift Card Terms and Conditions before either purchasing or using a gift card when using our Service.

Our fees

We take pride in the fact that 100% of your donation will be made to your chosen Recipient. However, there are third party fees involved in processing your donation which will be deducted from any donation amount. To meet the 100% donation, we ask that you bear the small charges of our third-party payment processors.

Our third-party payment processor is Stripe and their charges can be found here: https://stripe.com/gb/pricing and these charges will be deducted from your donation before your donation amount is paid to the Recipient. By paying this small charge, your chosen Recipient will therefore receive 100% of your donation.

Your account

When you register with us, you must provide us information that is accurate, complete, and current. Failure to do so constitutes a breach of these Terms and may result in immediate termination of your account on our Service.

It is your responsibility to safeguard any passwords that you may use to access the Service and for any activities or actions under your password. You are responsible for maintaining the confidentiality of your password to prevent others gaining access to your personal information. This extends to the use of your password both within our Service and on any third-party service i.e. when processing payment.

You agree not to disclose your password to any third party. In the event of a breach of security or unauthorised access of your account, you agree to notify us immediately as soon as you become aware of any such breach.

When you make a donation, the transaction is final and cannot be disputed unless it resulted from proven unauthorised use of your payment card or other payment method. In such case, upon becoming aware of fraudulent use of your card, you must notify your card provider in accordance with their reporting rules. In the event that such issues arise when using another payment method i.e. Stripe then you must contact the provider of that payment method directly.

Termination

In the event that you fail to comply with these Terms for any reason, we reserve the right at our sole discretion to immediately and without notice, or liability, suspend and/or permanently deny you access to all or part of our Service.

In the event that you wish to terminate your account, you may simply discontinue using the Service and/or delete the Service from your device. These Terms will continue to apply to your past use.

Intellectual property

This Service and its content, features and functionality are and will remain the exclusive property of The Dawah Project. The Dawah Project and its related company Islam Channel Limited are protected by copyright and trademark. Our name, trademarks and trade address may not be used in connection with any product or service without our prior written consent.

Prohibition on data extraction and distribution

By visiting or using the Service, you agree not to (and not to use any tool, program, script, browser extension or other technique, including bots, robots, spiders and scrapers and any similar tools or methods, in order to): (i) copy (except as authorised by these Terms), mirror, frame, index, scrape, mine or otherwise gather or extract any of the content or data from the Website or its associated services; or (ii) sell or distribute any data which is gathered or extracted in breach of these Terms, or which is based on or derived from any such data.

Rightgive may take any measures it sees fit to block access to the Service where it believes that these Terms have been or will be breached. You agree that you will not take any steps to try to circumvent these measures and that you will not take any steps to mask your IP address. You acknowledge and agree that where there is any actual or threatened breach of these Terms, damages may be an inadequate remedy and rightgive shall be entitled, without prejudice to any other rights and remedies it may have, to seek an injunction or any other equitable relief for such breach. Rightgive may also request that you destroy any data you have gathered or extracted in breach of these Terms and you agree that you will comply with such request promptly and certify the same.

Our Service may contain links to third-party website and/or services. Such third-party websites and/or services may not be owned or controlled by us. Where you chose to explore such website/ and/or service you accept that we have no control over and assume no responsibility for the third-party content, privacy policies, or practices etc. of any third-party websites and/or services.

You acknowledge and accept that we will not be liable or responsible either directly or indirectly, for any damage or loss caused by or in connection with the use of or reliance on any such content, goods or services available on or through any third-party website and/or services.

We would recommend that you thoroughly read the terms and conditions, privacy policies etc. of any third-party website and/or services that you visit from our Service platform.

Indemnification

You agree to defend, indemnify and hold harmless us, our employees, licensee and licensors, their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to legal fees), resulting from any use of the Service.

Disclaimer

By using our Service you agree that your use of our website, app and any of our associated services is on an "as is" and "as available" basis and is accessed at your sole risk. We do not warrant or guarantee continuous uninterrupted or secure access to our services as these may be interfered with by numerous factors outside of our control. On that basis, except as expressly set out in these Terms and except for the rights, guarantees and remedies which cannot be excluded, we do not provide other conditions, guarantees, warranties or terms in relation to our Service, to the extent permissible by law. We shall undertake general maintenance and upkeep of the Service from time to time. During these periods, our Service may not be available for use. In exceptional circumstances, the Service may also become unavailable at other times.

Limitation of liability

In no event shall we, or our directors, employees, partners, agents, suppliers, or affiliates, be liable for losses relating to any direct, indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, direct or indirect business of yours or lost or corrupt data, loss of profits, loss of contracts, loss of business opportunity, loss of sales, loss of revenue, loss of goodwill, loss of any software or data, loss of bargain, loss of opportunity, loss of use of computer equipment, loss of or waste of management or other staff time, even if we have been advised of the possibility of such damages. You hereby expressly agree to the allocation of risk set forth herein.

Governing law

These Terms shall be governed and construed in accordance with the laws of England and Wales.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after such revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.
